Birch Haven, LLC ("Company," "we," "us," or "our") is committed to protecting the privacy of individuals who visit our website at birchhaven.com (the "Site"). This Privacy Policy describes how we collect, use, share, safeguard, and dispose of the information you provide to us or that we collect about you through your use of the Site, and explains your choices regarding that information.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please discontinue use of the Site immediately.

This Privacy Policy is incorporated into and made a part of our Terms of Use.

Birch Haven, LLC is the parent holding company of several subsidiaries, including Birch Haven Management, LLC (rentbirchhaven.com) and Birch Haven Real Estate, LLC (birchhavenre.com). Each subsidiary operates its own website and maintains its own terms of use and privacy policy. This Privacy Policy applies solely to information collected through this Site.

 

2.     OPT-IN CONSENT AND COMMUNICATIONS

BY SUBMITTING A CONTACT FORM OR OTHERWISE PROVIDING YOUR CONTACT INFORMATION ON THIS SITE, YOU ARE AFFIRMATIVELY OPTING IN TO BE CONTACTED BY BIRCH HAVEN, LLC AND ITS SUBSIDIARY COMPANIES — INCLUDING BIRCH HAVEN MANAGEMENT, LLC AND BIRCH HAVEN REAL ESTATE, LLC — REGARDING THE PRODUCTS AND SERVICES OFFERED BY THOSE SUBSIDIARIES.

Your submission constitutes your express written consent to receive communications from us and our subsidiaries via telephone, email, and text message, which may include the use of automated or pre-recorded communications where permitted by applicable law, at the contact information you provide.

Consent is not a condition of any purchase, lease, or agreement with us or any of our subsidiaries.

You may withdraw your consent and opt out of future communications at any time by:

  • Replying STOP to any text message;

  • Following the unsubscribe instructions in any marketing email; or

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. We will honor deletion requests to the extent permitted by law, except where we are required or permitted to retain your information for legal, regulatory, or legitimate business purposes.

(c) Opt-Out of Communications. You may opt out of marketing and promotional communications at any time by following the unsubscribe instructions in any email, replying STOP to any SMS message, or contacting us directly. Even after opting out, you may continue to receive communications directly related to a specific inquiry you submitted.

(d) Cookies. You may adjust your browser settings to refuse or delete cookies. Note that doing so may affect the functionality of certain parts of the Site.

13.  GOVERNING LAW

This Privacy Policy is governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or related to this Privacy Policy shall be subject to the exclusive jurisdiction of the state and federal courts sitting in Hillsborough County, Florida.
